Terms of Use
Version 1.0 · 26 August 2026
These Terms of Use (the "Terms") govern your access to and use of the SpottAI mobile application (the "App") and the spottai.app website (together, the "Service"). The Service is published by Florian Duboc, sole trader (auto-entrepreneur), SIREN 835 165 101 (see the legal notice). By creating an account or using the Service, you accept these Terms. If you do not accept them, do not use the Service.
1. What SpottAI is
SpottAI is an AI strength-training coach. It builds training programs and adjusts your session set by set, in real time, based on what you tell it (effort, fatigue, pain, constraints). Coaching content is generated by artificial intelligence. SpottAI is a fitness and wellness tool; it is not a medical device and does not provide medical, health, nutritional or physiotherapy advice.
The Service is currently offered as a free beta. It is under active development, may contain errors, and may change, be interrupted or be discontinued at any time (see sections 10 and 13).
2. Eligibility
You must be at least 18 years old and have the legal capacity to enter into a contract. The Service is intended for an adult audience and is not directed at minors. You must use the Service for your own personal, non-commercial use.
3. Your account
You create an account by e-mail (one-time code) or with Google sign-in. You are responsible for the accuracy of the information you provide and for keeping access to your account secure. One person, one account. Tell us at contact@spottai.app if you believe your account has been compromised.
4. Health, safety and no medical advice
Physical training carries inherent risks of injury. You train at your own risk. Before starting or changing a training program, and especially if you have a health condition, an injury, are pregnant, or have any doubt, consult a qualified healthcare professional. SpottAI does not replace a doctor, physiotherapist or qualified in-person coach.
- The coaching, load recommendations and exercise choices are suggestions. You remain in control and are solely responsible for deciding what you do, for your form and technique, and for the safe use of any equipment.
- Stop immediately and seek medical attention if you feel pain, dizziness, shortness of breath or any warning sign. Do not push through pain because the App suggested a set.
- SpottAI relies on AI and on the information you give it. It can be wrong, incomplete or unsuitable for your situation. Use your own judgment.
- SpottAI makes no promise of any specific result (strength, physique, performance or health outcome).
5. Artificial intelligence
Coaching responses are produced by AI language models. AI output may be inaccurate, outdated or inappropriate ("hallucinations") and must not be relied upon as professional advice. Do not enter information you would not want processed as described in our privacy policy, and never rely on the coach for medical, legal, financial or other decisions requiring a qualified professional.
6. Acceptable use and fair use
You agree not to:
- use the Service in breach of the law, or for any harmful, abusive or fraudulent purpose;
- access the Service through automated means (bots, scraping), overload it, or attempt to bypass its security, rate limits or usage limits;
- reverse engineer, decompile or extract the source code, models, prompts or datasets behind the Service, except to the extent this restriction is prohibited by law;
- attempt to make the AI reveal its system instructions, produce harmful content, or use the Service to build or train a competing product;
- resell, sublicense or make the Service available to third parties, or use another person's account.
Fair use. AI coaching has a real cost per request. To keep the Service available and affordable for everyone, usage is subject to reasonable limits and safeguards. We may apply per-account limits and, in case of abusive, automated or disproportionate use, or of an attack on the Service, throttle, restrict or suspend access (see section 12).
7. Intellectual property
The SpottAI name, the App, the website, their content and design are protected and remain our property or that of our licensors. Exercise animations and media are used under licence from their respective authors. We grant you a personal, non-exclusive, non-transferable and revocable licence to use the Service for your own training, for the duration of these Terms.
You keep ownership of the content and information you submit (your profile, messages, notes). You grant us the licence needed to host and process that content in order to provide the Service, as described in the privacy policy. Coaching output generated for you may be used for your own personal training.
8. Paid subscriptions (when available)
Some features may later be offered through a paid subscription. When they are, purchases, billing, renewals and cancellations are handled by Google Play under Google's terms, from your Google account. Specific sale conditions will complement these Terms at that time. The following will apply:
- subscriptions renew automatically for the chosen period unless you cancel before renewal, via your Google Play account; cancellation takes effect at the end of the paid period;
- prices and plans may change; changes apply to future periods only and are notified in advance;
- you have the statutory right of withdrawal for distance contracts (14 days). Where you ask to access paid features immediately, performance begins during that period; you may still withdraw, in which case you owe an amount proportionate to what has been supplied. Purchases and refunds are processed by Google Play under its policies.
9. Personal data
We process your personal data, including health data, as described in our privacy policy. Health data is processed only with your explicit consent, which you can withdraw at any time. Please read that policy before using the Service.
10. Availability, "as is" and data
The Service is provided "as is" and "as available". As a free beta, it comes with no guarantee of availability, continuity, performance or absence of errors, and may be interrupted for maintenance, technical reasons or security.
We take reasonable care of your data but, for the free Service, we do not guarantee against the loss or corruption of your data (for example following an incident, a technical failure or a security event). To the extent permitted by law, we are not liable for such loss in the context of the free Service.
11. Liability
To the fullest extent permitted by law, we are not liable for indirect or unforeseeable damage, loss of data, or any harm resulting from your use of the Service, from AI output, or from training decisions you make. Because the Service is currently free, our liability is limited accordingly.
Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, in particular liability for bodily injury, for gross or wilful fault or fraud, for defective products, or your mandatory rights as a consumer.
12. Suspension and termination
You may stop using the Service at any time and delete your account from the App settings (see account deletion). We may suspend or terminate your access, with notice where reasonable, if you breach these Terms, misuse the Service, or where necessary to protect the Service, its users or its security (including in the event of abuse or an attack). Serious or unlawful breaches may lead to immediate suspension.
13. Discontinuation of the Service
We may discontinue all or part of the Service. If we discontinue it, we will give reasonable prior notice where feasible (by e-mail or in the App) and a period for you to export or delete your data before it is erased.
If paid subscriptions exist at that time and the Service is discontinued, we will stop future charges and refund the unused, prepaid part of a current subscription on a pro-rata basis, processed through Google Play. This does not affect your other rights under applicable consumer law.
14. Changes to these Terms
We may change these Terms for valid reasons (legal or regulatory changes, evolution of the Service, technical or security reasons). We will notify material changes by e-mail or in the App. If you do not accept a change, you must stop using the Service and may delete your account; continuing to use the Service after a change takes effect means you accept it.
15. Governing law and disputes
These Terms are governed by French law, without depriving you of the mandatory consumer-protection rules of your country of residence in the European Union. As a consumer, you may bring proceedings before the courts of your place of residence.
In case of a dispute, please first contact us at contact@spottai.app so we can seek an amicable solution. You may also use the European Online Dispute Resolution platform. A consumer mediator will be designated when paid services are launched.
16. Miscellaneous
- We are not liable for any failure caused by events beyond our reasonable control (force majeure).
- If a provision is held invalid, the remaining provisions stay in force.
- Not enforcing a provision is not a waiver of it.
- You may not transfer your account or these Terms; we may transfer them in connection with a reorganisation or transfer of the Service, without reducing your rights.
- These Terms, together with the privacy policy and the legal notice, form the entire agreement between you and us regarding the Service.
- These Terms are available in several languages. In case of discrepancy, the version in the language in which the Service was provided to you applies to your relationship with us.
